Please read these Terms and Conditions (“Agreement”) carefully before using our online ticketing software (“Software”). This Agreement sets forth the legally binding terms and conditions for your use of the Software provided by VMCParks. By accessing or using the Software, you agree to be bound by this Agreement.

  1. Use of Software

1.1 Eligibility: You must be at least 18 years old or the legal age of majority in your jurisdiction to use the Software. By using the Software, you represent and warrant that you meet the eligibility requirements.

1.2 License: Subject to your compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Software for the purpose of purchasing tickets for events offered through the Software.

1.3 Account Registration: In order to use certain features of the Software, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

  1. Ticket Purchases

2.1 Availability and Pricing: The availability and pricing of tickets for events are determined by the event organizers. We do not guarantee the availability of specific tickets or the accuracy of pricing information. Prices may be subject to change without notice.

2.2 Payment: When purchasing tickets through the Software, you agree to provide accurate and complete payment information. You authorize us or our third-party payment processors to charge the total amount of your purchase to the provided payment method.

2.3 Refunds and Exchanges: Ticket refunds and exchanges are subject to the refund and exchange policy of the event organizer. We are not responsible for issuing refunds or facilitating exchanges unless otherwise stated by the event organizer.

2.4 Event Organizer Terms: Each event may have additional terms and conditions imposed by the event organizer. You agree to comply with all event-specific terms and conditions, including any age restrictions, dress codes, or prohibited items.

  1. User Conduct

3.1 Prohibited Activities: You agree not to engage in any of the following activities:

a) Violating any applicable laws, regulations, or third-party rights. b) Interfering with the operation or security of the Software or attempting to gain unauthorized access to any related systems or networks. c) Engaging in any fraudulent or misleading behavior, including the purchase of tickets with the intent to resell at a higher price. d) Using the Software for any unauthorized or illegal purposes.

3.2 Content Standards: You are solely responsible for any content you post, transmit, or share through the Software. You agree that your content will not:

a) Violate any intellectual property rights or other proprietary rights of any party. b) Be false, misleading, or deceptive. c) Contain any offensive, defamatory, or harmful content. d) Violate any applicable laws or regulations.

  1. Intellectual Property

4.1 Ownership: The Software and all intellectual property rights, including copyrights, trademarks, and trade secrets, associated with the Software are owned by the Company or its licensors. You acknowledge and agree that you do not acquire any ownership rights or licenses to the Software or its contents.

4.2 Restrictions: You agree not to modify, reproduce, distribute, create derivative works of, publicly display, or use any portion of the Software without our prior written consent.

  1. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE, UNINTERRUPTED, OR FREE OF HARMFUL COMPONENTS. YOU ACKNOWLEDGE AND AGREE THAT YOUR USE OF THE SOFTWARE IS AT YOUR SOLE RISK.

  1. Limitation of Liability

IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SOFTWARE OR ANY CONTENT OR SERVICES PROVIDED THROUGH THE SOFTWARE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THIS AGREEMENT OR YOUR USE OF THE SOFTWARE SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU, IF ANY, FOR THE TICKET PURCHASE GIVING RISE TO THE CLAIM.

  1. Indemnification

You agree to indemnify, defend, and hold us harmless from any claims, losses, damages, liabilities, and expenses (including attorneys’ fees) arising out of or related to:

a) Your use of the Software; b) Any violation of this Agreement or any applicable laws, regulations, or third-party rights; c) Your violation of any rights of another user or event organizer; d) Any unauthorized use or access to the Software; e) Any negligent or wrongful act or omission by you; or f) Any dispute or issue arising between you and any third party, including event organizers or other users.

  1. Termination

We may, in our sole discretion, terminate or suspend your access to the Software, with or without cause or notice, including if we believe that you have violated this Agreement or any applicable laws or regulations. Upon termination, you must cease all use of the Software, and any rights and licenses granted to you under this Agreement will immediately terminate.

  1. Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of Andhra Pradesh. Any disputes arising out of or relating to this Agreement or your use of the Software shall be subject to the exclusive jurisdiction of the courts located in Vijyawada, Andhra Pradesh

  1. Severability

If any provision of this Agreement is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

  1. Entire Agreement

This Agreement constitutes the entire agreement between you and us regarding your use of the Software and supersedes any prior or contemporaneous agreements, communications, or understandings, whether oral or written, relating to the subject matter herein.
